Tried to use my own images for Wikipedia but identified as copyright violation[edit]

Wizard upload not always working[edit]

For a week, I get error messages using the upload wizard: "Internal error: Server failed to store temporary file." I cannot always the classic upload because some files are over 100 mb Smaxims (talk) 10:09, 14 December 2023 (UTC)Reply[reply]

Thx, but it won’t work. After uploading chunks and trying to assemble them on the server side, I got the message "00208: FAILED: stashfailed: Internal error: Server failed to store temporary file.".
And anyway, it is not a solution for a multiple upload, just a possible workaround (which want work for me) for a single file upload Smaxims (talk) 11:14, 14 December 2023 (UTC)Reply[reply]

Jmabel Thanks :) Yes I had the same issue, I started a phabricator bug report here, please Smaxims and Alexkrakovsky can you share there what happened, what file it was including a link if you can (even if you've managed to find a workaround the engineer can test it because it fails before the duplicate file check). Licensing[edit]

It is frustrating that the photographer Harald Krichel whose many photos are available on Wikimedia/Wikipedia is using the services of Pixsy to bully and threaten small businesses and bloggers with copyright infringement lawsuits. This is hardly in the spirit of Wikimedia and the CC licenses available. Please reconsider your relationship with this photographer. @IP the accusation is really strange as Seewolf is a member of VRT, has not uploaded "many photos", but only 125, has mostly imported files (PD or as an importer for VRT), only uploaded few "own" files (Seewolf could only for these make "bully and threaten") and Seewolf's "own" uploads are cc-by-sa-4.0 - a forgiving license that is avoided by copyright trolls. Creative Commons frowns on such behavior. Their statement relating to copyleft trolls can be found below:
"Put simply, “license-enforcement-as-business model” is a perversion of the founding ideals of Creative Commons. We condemn this behavior.
These aggressive enforcement actions lessen trust in open licensing, and they erode the good faith ecosystem that is the basis of the commons.
Together with our community, we will continue to take action to deter those who leverage CC licenses in bad faith. The health of the commons

A growing number of us who have been harassed by Pixsy, acting on behalf of the photographers they represent, are planning to launch a Subreddit and website on this topic. The aim of this Subreddit/Site will be to share the names of these bad-faith actors and to provide support and resources for those who are dealing with similar legal threats and harassment.
If Pixsy truly cared about enforcing photographers' copyrights, they would focus on real copyright infringement rather than attempting to extract money for minor attribution errors. Please exclude SVG translations via the SVG Translate tool from Special:AbuseFilter/290[edit]

Hello. Mere translations of SVG files via the SVG Translate tool should be exempted from Special:AbuseFilter/290. This tool only lets users translate text labels in existing SVG files, which is a far cry from the major, disruptive overwrites that this abuse filter seeks to prevent. Thank you. @Leptictidium: In your last attempt to upload File:Route Punic army messana.svg, logged here, the tool wrote "Added translation for ca." at the end of the comment/summary/reason for you. @GPSLeo: this should have matched. When I translated the file, I got a similar comment/summary/reason (different language abbreviation), without allowing me any input but the language name. Derivative figures included in an open access academic article[edit]

Hi, I recently came across a scholarly article that includes many valuable images related to the embryologist Wilhelm His, Sr. I wish to upload them, but as a first-time user of Wikimedia Commons, I am unsure as to whether permission is required. Most of the figures are photographs of historical images/objects, and the article itself is released under the CC BY 4.0 license (cf. article page and [1]). So I suspect they count as Commons:Derivative works with appropriate licenses and are hence acceptable here.

I have two questions:

1. Would it be acceptable to crop these figures, as most of them are montages of multiple images? In fact, since the montages are created out of various different sources, I think it would be easier to document information if each individual image was cropped and uploaded.

2. The authors go out of their way to specify "image rights" for certain images (e. g., Figure 1D). Is permission necessary for such images, even if the article itself is open access? If so, would it suffice to contact the authors of the article, or would I have to obtain permission from the owners of the "image rights"?

@Ymed16: this is a tough one to answer entirely, because potentially each image could have its own issues. At a quick glance, most of this looks old enough to probably (but in some cases not certainly) have passed into the public domain but, for example, portions of Figure 16 do not. So you are going to have to go through this and work it out on a case-by-case basis.
You mention image 1D; I can see no way this would still be copyrighted.
It's fine to take individual images out of the larger figures.

Computer generated images used in the contests[edit]

Hello, i am an active member of Wikimedia commons. As amateur photographer, i like to join contests. I use my own photographs taken with my Canon camera. I would like to make sure that only our own images taken as "humans" and not generated by AI are participating in the contests. is there any one of the admin or moderators guys who vet the pictures in the contests? Are we all ensured that no AI Pictures are becoming part of the list of pics that compete in the contest? what happens if some of us check the pics and see that there are some AI pictures in the contest? can we report them or those pics are fully allowed in the competition? i didnt find anything that explicitly forbids the usage of AI but i found an implicit statement as you see in "Photo Challenge" page info:
"The Photo Challenge inspires photographers to take great pictures and upload them to Commons. Monthly thematic competitions encourage participants to try new subjects, new photographic or processing techniques, and to develop skills while improving the Commons repository of free images. Photographs entered into a competition must be new to Commons and taken by a Commons user."
Added to this is my consideration (that i assume is the consideration made by many of us, as members of Wikimedia : we are talking about contest of pictures, photographs. This is obviously related to an art, photography, made by users. Not by robots, computers, or softwares. They are not allowed to compete, am i wrong?
Due to this, i would like to suggest to the wikimedia admins to add an explicit rule which forbids the usage of AI generated images in the contest. As participant, i would like to be ensured that only real pictures "taken" by users are part of the contest.

Admins have no special role in making rules, only in enforcing them.
The rules of any given contest are up to the people organizing the contest.

How to use the totally free images of wikipedia commons?[edit]

In the past, it was easy to use wikipedia commons. Now, they made it extremely unpleasant and infuriating. It's clearly on purpose since the photos are supposedly free. To improve the difficulty to use the system, I would suggest that they put a 65 pages long tutorial document to be read every time we want to download a photo on our computer. They could also force us to invent five different passwords (to be changed every week) and force us to use three different codes sent on three different telephone numbers. All that should be asked in Chinese or Turkish to make it even more unpleasant. I will try to find more difficult way to use that damned system. Thank you in advance. Excluding a user's uploads from search?[edit]

If I want to not see a certain user's uploads when searching for files, is there a way to do that? Appending to my search the expected "-User:Example" doesn't work. –Vuccala (talk) 14:02, 21 December 2023 (UTC)Reply[reply]

I assume that you have already explored the search help of MediaWiki and found nothing. I do not know an answer. But here is an idea. If you want to exclude a user's uploads, presumably it may be because that user has a lot of uploads? And if the user has a lot of uploads, then, with a bit of luck, there may be a category such as "Category:Uploads by Example". After more thought, that idea was not useful, because if the string "Example" is displayed only in a category, it is found by the simple "-Example". Vuccala Note that this will only work, if the user has oneself included as author (usually). This won’t work for files where the user is only the uploader, e.g. the search query file: bluecheek butterflyfishes yields today 4 results. But that's the thing? @Vuccala wants to exclude the files authored by a specific user, not files that have been uploaded by a user, but are imported and could have been imported by anyone else? OTOH if you want to exclude mass uploads by a user (if only few search results are from the user, then why make the effort to exlude this few unwanted files from the search result), Then there will be in most cases a category like "imports from XY-GLAM by UserYX". That's not how I read the OP's question. Although it would help if they clarified it with at least an actual case. If the goal was merely to exclude all files authored by a user, identified in the description pages, the simple "-Username" should do it. (Not "-User:Username", because "User:" is generally either not displayed or not written, although it would be found with -insource if it is written in the wikicode.) The OP says that they do not want to see the "user's uploads", which I understand as meaning all files uploaded by the user, including all the files not authored by the user, and including all the files where the username is not present (save in the file history), which is precisely the difficulty. Filtering with categories was my first idea mentioned above, but it probably has no more advantage than the simple "-Username". The -insource syntax may find also the rare cases where the username is present in the wikicode without being displayed. I'd like to exclude files both authored and uploaded by a user, but I think the solution Jmabel gave works well enough. (and a correction, yes, just -insource:"USERNAME" is better, without the User: bit.)
@Asclepias: I'll clarify with an actual case. I'm often searching for photos of animals and get many unwanted results of some user's bulk upload of sports teams/entertainers/cartoons/etc. that contain that animal name. For example, searching "vixen" is frustrating because there's an entertainer with that name but since most of the uploads are from "S._Bollmann" I can now append "-insource:S._Bollmann" to get rid of them. But continuing, there's further unwanted results of museum pottery uploaded by user "Pharos" which I'd like to remove, but since his username isn't in the source, -insource:Pharos doesn't work but I can instead use something like -insource:metmuseum.
The main thing, I think, is that I'm pretty new here and it didn't occur to me to use -insource: along with authors/usernames like that.–Vuccala (talk) 14:32, 24 December 2023 (UTC)Reply[reply]

The string "Speravir" is displayed in the license review section of that description page. That's possibly how the syntax "-Speravir" finds it. The string "User:Speravir" is not present, even in the wikicode, and it is not found with -insource. But the string "Speravir" is present and is found. The -insource:username does not work when the uploader's username is present only in the file history. For example, the file File:James Weddell Expedition.jpg is not filtered out by it. (By the way, does the review of File:2 Bluecheek butterflyfishes (px-380037).jpg meet the condition "Reviews by image-reviewers on their own uploads will be considered invalid."?) -- Asclepias (talk) 03:46, 23 December 2023 (UTC)Reply[reply]

What are the copyright laws in the EU of inherited artworks.[edit]

I am working on the Wikipedia page of my great-grandfather, who was a famous painter in Hungary. We'd like to upload some of his work to the site, but I'm not sure about the copyright laws. He died 52 years ago. He had a son (my grandfather) who inherited all his paintings and drawings. He has approved for me to upload some paintings, but we don't know if that's enough. @Szerkesztő.2244: The normal copyright terms is 70 years after death per [:Commons:Copyright rules by territory/Hungary]] but, until that time is over, the heir could release the paintings under a free licence we accept. If the image includes a frame or something 3-dimensional outside the painting area itself, the photographer's permission is additionally required. It sounds like your grandfather is still the copyright holder, so we would need to obtain his permission. He can do that by completing the consent as detailed on this page Commons:Email templates/Consent. Then you can use one of these copyright templates specifically for heirs Category:License tags for transferred copyright, preferably one of the first 5 listed. @Ww2censor: more precisely, the father is now the copyright-holder, having inherited the intellectual property rights from the grandfather. But, yes. @BELORECKIYSHARIK: Presumably there is no free license available: there wouldn't normally be for something like this. The question is whether it is copyrightable. If you can find an example of pretty much exactly that "lion rampant" from the 19th Century (the easiest way to establish that the lion is public domain), I'd say there is nothing else copyrightable in that logo, so with that citation of prior art it would be uploadable to Commons with some combination of PD licenses (probably {{PD-old-assumed-expired}} for the lion and {{PD-textlogo}} for the rest, plus {{Trademarked}}. That's a little tricky, so if you upload it on that basis please link it here on Help desk (in this section, if this section hasn't been archived) so that someone can check your work and fix it if you didn't get it quite right.

@Juandev: We block those when found (fine for reading, of course). There is a way for a particular account to be made an exception.   • @AbchyZa22: el parte arriba contiene una linea de fotos que presumiblemente tienen derechos de autor. Eso no se permite.
  • Normalmente, no aceptamos tablas en la forma de imágenes. Hi I just created this new category, which I intend to be a subcategory of the parent Category:East African Campaign (World War I) but I can’t figure out how to do this using HotCat and don’t want to make a mess. Well the category has already some images see Category:Kantonspolizei Thurgau. If you want to ad images to the category, the categories are at the bottom of every page and with hitting the + sign a field in which you can add letters in it opens. @Jeraxmoira: I've never used Twinkle, so I have no basis or comparison. Speedy-deletion tags can be placed either manually or with VFC (for multiple identical SD requests). I suspect there are other ways as well, but these are the two I use. Do note, though: when asking for something to be speedy-deleted as a copyvio, you probably don't want to do something "mass", because you should present evidence (like a link to source). - Jmabel ! talk 20:18, 23 December 2023 (UTC)Reply[reply]

For information, archived copies of the full source article can be read at archive.org, but it doesn't provide any information about the copyright. That newspaper may have reproduced the image by some reason of fair use or news media or something else. The best way to have a safe answer about the copyright status of the official version of this artwork would be to obtain an official statement on this matter from the municipal council of Caracas and from Omar Cruz, the artist who created the artwork. Someone interested should try to obtain that.
Other than that, it is a question for jurists in Venezuelan law.
Here, I think we can only make a few partial observations:
Someone in the DR quotes some bits of art. 2 of the copyright law to argue that this artistic work is not covered by the copyright law. That doesn't work. Cf. the first paragraph of art. 1: "Las disposiciones de esta Ley protegen los derechos de los autores sobre todas las obras del ingenio de caracter creador, ya sean de indole literaria, cientifica o artistica, cualesquiera sea su género, forma de expresion, mérito o destino." and the end of art. 2: "Se consideran comprendidas, entre las obras del ingenio a que se refiere el articulo anterior, especialmente las siguientes: [...] toda produccion literaria, cientifica o artistica suseptible de ser divulgada o publicada por cualquier medio o procedimiento.". Art. 2 is not limitative. There is nothing in that article that excludes artistic works from the law just because they are artistic renderings of coats of arms.
In the Ley Orgánica, art. 321 states "Normativa aplicable: Toda producción intelectual que se genere en el proceso social de trabajo se regirá por las leyes que regulan la materia, bien sean: obras del intelecto o actividades conexas, invenciones, diseños industriales o marcas. [...]". The various articles from 320 to 329 do not always mention the same terms. For example, art. 329 mentions "obras de carácter [...] artístico". The title of art. 325 mentions "Invenciones, innovaciones y mejoras". One would have to determine if art. 325 applies to this type of artistic works, and, if so, then one would have to determine if this particular work by Omar Cruz was "generada bajo relación de trabajo en el sector público, o financiada a través de fondos públicos". All that is a matter for specialized jurists in Venezuelan law.
Another thing to consider is to determine what the copyright status of the work is in the United States. If it is in the public domain in Venezuela, what is the status in the United States and who, if anyone, owns the copyright in the United States? That question could be asked also at Commons:Village pump/Copyright.
Again, instead of debating on Commons, the best and easiest solution is to obtain a statement from the municipal council of Caracas and from Omar Cruz. If they agree that this work is in the public domain in Venezuela and in the United States, then the matter is solved to the satisfaction of everybody. If they say that it is protected by copyright and not free, either in Venezuela or in the United States, then it is better to not host it on Commons, unless someone is prepared to have a legal argument with them. -- Asclepias (talk) 20:56, 24 December 2023 (UTC)Reply[reply]

@Jmabel: I can't make it out, except for the letters LA (for Los Angeles) on the second line. But this appears to be one of several publicity photos of Walthall taken by, or at least published by, the Category:Photoplayers Studio in Los Angeles, which was active in the 1910s and 20s: here's a copy of the same photo, with the Photoplayers signature; and here's another photo obviously taken at the same sitting, again with the Photoplayers signature. If the version published in the Town Crier has a different signature, perhaps the original photographer joined the studio, or studio bought out and rebranded his work? Incidentally, I think the file name and description of File:Henry B. Walthall in Ibsen's "Ghosts".jpg is misleading. This appears to be one of a series of general publicity photos, not a photo of Walthall specifically in the role of Osvald in Ibsen's Ghosts, and the source doesn't claim that the photo has anything to do with Ghosts. Searching around at archive.org and newspapers.com, I found that the LA Photoplayers Studio was founded in 1914 – by three persons, G(eorge) G. Wells, E(thel) F. Vincent, and Harry N. Naugle –, and the last I could find of them was a 1919 newspaper item that they had won a lawsuit against comedians Kolb and Dill. Ha :-) Harry D. Naugle (not "N." as I first thought) was a guy active in film distribution. He was the manager of Clune's Broadway Theatre in LA until 1914, then worked for various "exchange" companies as they were called then, in 1917 for Vitagraph. He was probably the guy providing money and left to pursue other career goals. That leaves the other two as the actual photographers. I didn't have much luck finding anything about George G. Wells, but Ancestry gave me an Ethel Vincent, born in Minnesota in 1892, present in LA from 1910 and apparently a photographer. That might be the Ethel F. Another question. This Flickr user uploaded his images under CC BY 2.0 license. But in his "about" page he wrote that he forbid the usages of his pictures in pornographic, violent or radical context. Here in Commons only the materials that can used "by anyone, anytime, for any purpose" are allowed. I looked everywhere for a link to such a page. The "Help center" on the left does not link to it. There is a completely different "Help desk" (here), which is reached only through "Village pump", which makes it difficult to imagine how one might find it (why isn't a link to the Help desk on the Help center?). The link, which I see now at the top right, disappears when one presses + to add a comment to this page. Very confusing.
So, armed with the title you provided, I found and went to the page, and clicked the button to make a new request. Too many people try to upload audio files that are still copyrighted by the authors, performers, recorders, publishing companies, etc. without proper licenses from those people. Please document fully the sources and licenses of your audio uploads, and request Autopatrol group membership at COM:RFR when you think you are ready (once you have made more than 500 useful non-botlike edits); having that should allow you to upload mp3 files. I'm not sure I understand the question; I'm guessing you want to overwrite your own upload. In English, there is a link under the file history section, "Upload a new version of this file". Red 34 Ford Pickup with tonneau cover[edit]

Why is the pickup called a utility, is this a common AUSIE reference for a pickup? I live in the USA and own a custom 36 Chevy low window pickup that I had an aluminum "Flush Fit" Tonneau cover made for it ! I now have a 2003 Chevy XTREME Step Side I would like to buy a Tonneau Cover for but after so many years of hunting I`m going to have to build one from a Standard long bed... I hope it works! Upload audio ogg file, adding "children" to infobox, adding "signature" to infobox[edit]

Hello, How do I add and audio file (ogg) to Wiki Commons? I am not sure what choices to make. It is for a musical artist. I am building her wikipedia pages. I would like to add "children" and her "signature" to her infobox. However I do not have the choices for "children" nor "signature." Do you give permission for this? If I go to the Community Portal, would they be able to help me with this?

@Wiki-Wiki-2028 Oh dear, so many things come together and get mixed up. I assume the article for the musician was supposed to be in the English Wikipedia and has already been deleted. That's something you need to clarify on the English-language Wikipedia and not here on Commons. Likewise the questions about the infobox and the children. You have uploaded several images here on Commons. One with the signature. That's fine so far and when the article is (again) available on the English-language Wikipedia, you can also clarify this there. However, you have uploaded further images of which you say that you are the author. However, these are very low-resolution images. This is undesirable here and is often a sign of stolen images. So if they really are yours, please upload them in full resolution and verify them with VRT. The VRT process has already started for one image, but you will probably have to add more. Then you seem to be writing on behalf of the musician, you must at least disclose this on the English-language Wikipedia, otherwise you will be banned. I wanna make a wikipedia page about my grandgrandfather who was a big artist and renovated for big churches in the mid 1900's, but when I try to upload some foto's it says that you couldn't figure out if the pictures arent copyrighted or something. I had these pictures in the living room since god knows what. Please help me update them I means a lot to me and I just feel like he deserves a wikipedia page after what has he done. OK, his works are protected in Czechia until January 1, 2035 and cannot be uploaded on Commons until then. English Wikipedia would only require publication before 1928 so works published before then can be locally uploaded there. (Yes, copyright terms are rather long). @Abzeronow and Proftomasek: other than the remark about en:WP:COI (Proftomasek, please do read that) that's not quite on the mark. If Proftomasek is the heir to their (I assume from the odd wording) great-grandfather's intellectual property, and if their great-grandfather took the photos, they could upload them here under an "heirs" license tag such as {{Cc-by-sa-4.0-heirs}} or {{heirs}}. On the other hand, if the photos were taken by someone else, that person or their heirs would have to give the relevant permissions. Also, if the photos are previously published, you would definitely have to go through the process described at COM:VRT.
Proftomasek, I'd be glad to work with you on what can or can't be done. The Commons side of this is going to come down mainly to copyright issues; the Wikipedia side is going to come down mainly to conflict-of-interest issues. @Proftomasek: quite a bit in these uploads is at least problematic. You never did say whether you are the heir to the relevant intellectual property. If you are, most of this is easily cleared up. If not, it's hard to see how we can keep anything but the signature.
I'm sorry, I'm sure this is not what you wanted to hear, but the simple fact is that Commons only hosts works that are either public domain or have an appropriate free license, and only a person who holds the copyright can issue the license. For File:Jan Tomášek podpis.jpg, you are claiming to own a copyright and to issue a license on something that is probably not copyrightable; it should probably be re-tagged at {{PD-ineligible}}, and we can keep it on that basis. For the other two, you are claiming to own a copyright and to issue a license on something that was certainly originally copyrightable, may still be copyrighted, is certainly not your "own work", and where it is not clear whether you own the copyright, and (if so) on what basis. - Jmabel ! talk 19:57, 28 December 2023 (UTC)Reply[reply]

@TudorTulok: that logo is right on the edge as to whether it is copyrightable. I'd seek others' opinion at Commons:Village pump/Copyright. If you ask there, mention that this is about Canada, because the threshold of originality varies from country to country.
In any case, if all you are concerned with here is to get the logo into an English-language Wikipedia article, not specifically onto Commons, en-wiki (but not Commons) allows non-free use for cases like this. Help with dilemma involving file renaming[edit]

I was trying to help with the backlog in Category:Media requiring renaming and I noticed a pattern. Kakibukitcibalak (talk · contribs) is tagging several files uploaded by Thalialioo (talk · contribs) for renaming, claiming that the person in the picture is not the correct indentified. See File:A group photo of people in a room.jpg, File:Juliarti Rahayu Gunawan 17 Agustusan Di Armidale Australia (cropped).jpg, File:A group photo of unknown people 2.jpg, File:Nia Kurniasih Ardikoesoema in Juanda International Airport 2014 (cropped).jpg for reference. @Darren J. Prior: it appears on all contribution pages, beside those edits that are the latest made to the page. In other words, nothing has changed there since that edit was made, and in the page’s history it would appear at the top.
